**INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA**<\/p>\n

This notice pertains to the data processing carried out by Mr. Niceguy snc, with its registered office in Ceva (CN), Via Aldo Moro 9 – 12073, VAT No. 03482230046, email privacy@cherrypieeyewear.it (hereinafter, the \u201cController\u201d), in accordance with EU Regulation 2016\/679 (hereinafter \u201cGDPR\u201d).<\/p>\n

The Controller may process personal data related to customers, suppliers, agents, and consultants, whether they are interested parties and\/or contractors, as defined by the current legislation on personal data.<\/p>\n

**Identity and contact details of the data controller**<\/p>\n

The data controller is Mr. Niceguy snc.<\/p>\n

As the Controller is established within the Italian territory, no representative has been appointed.<\/p>\n

The Controller has appointed a Data Protection Officer (\u201cDPO\u201d). The DPO can be contacted at the Controller\u2019s addresses or at dpo@cherrypieeyewear.it.<\/p>\n

**Purpose and legal basis of the processing**<\/p>\n

Personal data will be processed for the following purposes:<\/p>\n

– For contractual and\/or pre-contractual purposes, as well as to fulfill any legal obligations related to such purposes. In this case, the legal basis is the necessity to proceed with the processing for the execution of the contract and\/or for the management of pre-contractual relationships;
– To send direct marketing communications, newsletters, advertising material via automated computer systems, including commercial or promotional communications via email or SMS, or for market research and analysis. In this case, the legal basis is the consent given in accordance with this notice;
– For purposes related to legal obligations if processing has been carried out for the purposes mentioned in letter a). In this case, the legal basis is the Controller\u2019s legal obligation to process such personal data in accordance with applicable national legislation.<\/p>\n

**Processing methods and logic**<\/p>\n

In relation to personal data processed and stored for the purposes referred to in point a) and c), number 2 of this notice, processing will be carried out using paper documents, automated logic, and the use of CRM management software that will allow better management of contractual obligations.
In relation to personal data processed for the purposes referred to in point b), number 2 of this notice, processing will be carried out using commercial information sending software.<\/p>\n

**Source of personal data**<\/p>\n

Only data provided in accordance with this notice will be processed.<\/p>\n

No personal data from publicly accessible sources will be processed.<\/p>\n

**Recipients and categories of data recipients**<\/p>\n

Personal data may be disclosed to:<\/p>\n

– Communication companies that carry out commercial communication activities on behalf of the Controller, if the relevant consent has been expressed, which will be considered data processors;
– Companies that offer information society services, including, in particular, hosting service providers.<\/p>\n

**Categories of data**<\/p>\n

Personal data will be processed. Special categories of data as per Art. 9 GDPR will not be processed under any circumstances.<\/p>\n

**Data transfer**<\/p>\n

The Controller intends to transfer personal data to a third country or international organization. These entities may include, for example:<\/p>\n

– Communication companies that carry out communication activities on behalf of the Controller;
– Providers of information society services;
– Controlled and\/or controlling organizations.<\/p>\n

The transfer of personal data to such entities, if established in a third country or an international organization, is carried out in the presence of an adequacy decision by the European Commission, which has verified that the third country, territory, or one or more specific sectors within the third country, or the international organization in question ensure an adequate level of protection of the rights. In any case, the Controller \u2013 where deemed appropriate \u2013 reserves the right to conclude specific separate agreements that oblige such entities to adopt adequate security measures, including organizational measures, to offer appropriate guarantees regarding rights. The data may thus be transferred to the following countries: United States of America. To obtain a copy of such data or the place where they have been made available, it is sufficient to send a request to the Controller at the addresses indicated above.<\/p>\n

**Retention period of personal data**<\/p>\n

– Personal data processed and stored for the purposes referred to in point a) number 2 of this notice will be processed for a period not exceeding 10 (ten) years from the termination of the contract, in case of conclusion thereof, and, in the case of mere pre-contractual negotiations, for a period not exceeding 10 (ten) years from the termination of negotiations;
– Personal data processed for the purposes referred to in point b) number 2 of this notice will be processed and stored until the data subject requests deletion and\/or revocation;
– Personal data processed and stored for the purposes referred to in point c) number 2 will be processed and stored for a period not exceeding 10 (ten) years from the termination of the contract, in case of conclusion thereof, and, in the case of mere pre-contractual negotiations, for a period not exceeding 10 (ten) years from the termination of negotiations, without prejudice, in any case, to different legal norms.<\/p>\n

**Optional nature of consent and consequences of non-consent**<\/p>\n

– In relation to personal data processed and stored for the purposes referred to in point a) number 2 of this notice, the provision of personal data is a contractual obligation and a necessary requirement for conducting pre-contractual negotiations and concluding the contract. The data subject may provide personal data; however, in case of non-provision of such data, it will not be possible to conclude any contract or conduct any contractual negotiation;
– In relation to personal data processed for the purposes referred to in point b) number 2 of this notice, the provision of personal data is not a contractual obligation. The data subject may provide personal data; however, in case of non-provision of such data, it will not be possible to carry out any marketing activity;
– In relation to personal data processed for the purposes referred to in point c) number 2 of this notice, the provision of personal data is a legal obligation. In this case, it is mandatory to provide personal data; in case of non-provision of such data, it will not be possible to conclude the contract.<\/p>\n

**Right to object**<\/p>\n

The data subject has the right to object as follows:<\/p>\n

– The right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them pursuant to Article 6(1)(e) or (f) of the GDPR, including profiling based on these provisions. The Controller will refrain from further processing personal data unless it demonstrates compelling legitimate grounds for processing that override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defense of legal claims;
– If personal data are processed for direct marketing purposes, there is the right to object at any time to the processing of personal data concerning them for such marketing, including profiling to the extent that it is related to such direct marketing;
– If the data subject objects to processing for direct marketing purposes, personal data will no longer be processed for such purposes. It is specified that the data subject’s right to object to the processing of their personal data for the aforementioned purposes can be exercised in part, for example, by opposing only the sending of promotional communications carried out through automated and\/or digital tools, or the sending of paper communications;
– If personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, the data subject, on grounds relating to their particular situation, has the right to object to the processing of personal data concerning them, unless the processing is necessary for the performance of a task carried out for reasons of public interest.<\/p>\n

**Other rights**<\/p>\n

The Controller also informs you of the existence of the following rights:<\/p>\n

– Right of access: the data subject has the right to obtain from the Controller confirmation as to whether or not personal data concerning them are being processed, and, where that is the case, access to the personal data and specific information, in accordance with Art. 15 of the GDPR;
– Right to rectification: the data subject has the right to obtain from the Controller without undue delay the rectification of inaccurate personal data concerning them. Taking into account the purposes of the processing, the data subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement, in accordance with Art. 16 of the GDPR;
– Right to erasure, including the right to withdraw consent: the data subject has the right to obtain from the Controller the erasure of personal data concerning them without undue delay and the Controller has the obligation to erase personal data without undue delay, or to withdraw their consent, if the grounds defined by Art. 17 of the GDPR apply. Regarding the right to withdraw consent, the data subject also has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal;
– Right to restriction of processing: the data subject has the right to obtain from the Controller the restriction of processing where the cases defined by Art. 18 of the GDPR apply;
– Right to data portability: the data subject has the right to receive the personal data concerning them, which they have provided to the Controller, in a structured, commonly used, and machine-readable format and has the right to transmit those data to another controller without hindrance from the Controller where the conditions specified by Art. 20 of the GDPR apply;
– Right to object to commercial communications: the contractor has the right to object at any time, free of charge, to receiving commercial communications.<\/p>\n

**Right to lodge a complaint with the Supervisory Authority**<\/p>\n

You have the right to lodge a complaint with the Supervisory Authority for the Protection of Personal Data to complain about a violation of the rules on personal data protection, in accordance with Article 77 of the GDPR.<\/p>\n

**Exercising your rights**<\/p>\n

Requests to exercise the rights indicated in this notice, including, in particular, the right to erasure and the right to withdraw consent, should be addressed directly<\/p>\n
